晓静 那 我们 今天 话题 呢 要 聊 的 是 这个 就是 遇到 上门 推销 以后 ， 我们 应该 怎么办 哈 ， 那么 说 到 这个 就是 上门 推销 ， 我们 常见 的 有 三种 ， 刚刚 也 提到 过 ， 那么 其中 一种 呢 ， 就是 这种 登门拜访 的 敲门 推销 ， 或者 通过 电话 推销 ， 或者 呢 是 在 商场 大街 上 走上 来 就是 跟 你 来 搭讪 的 那种 推销 ， 那么 就是 我 想 哈 这个 最后 一种 情况 是 属于 在 公共场合 这种 随机 的 邂逅 ， 我们 作为 一个 路人 的话 ， 既 可以 选择 和 对方 去 聊 一聊 ， 那么 也 可以 选择 拒绝 ， 但是 对于 前面 两种 情况 的话 我们 可能 就是说 是 避 之 不及 的 ， 那 就是 今天 节目 呢 来 跟 大家 聊一聊 在 遇到 这种 上门 推销 的 情况 下 ， 我们 可以 怎么办 ？ 那 首先 我们 来看 一下 这种 这个 登门拜访 的 这种 敲门 的 推销 哈 ， 那么 我 想 这个 敲门 这个 推销 在 澳大利亚 应该 是 属于 合法 的 是 吧 。

晓静 : 嗯 是 ， 只要 他 的 就是 目的 是 正常 的 销售 的话 ， 他 是 不 需要 任何 的 执照 他 是 可以 是 说 可以 上门 的 。

主播 :嗯 ，就是说 对于 这些 那个 上门 推销 的人 来说 他们 本身 其实 不 需要 什么 一些 那个 资质 或是 其他 要求 是吗 ？

晓静 :对 的 ，但是 就 说 我们 是 对 他 的 时间 拜访 的 时间 和 打电话 的 时间 有 严格 限制 。

晓静 :但是 对 ，就是说 什么 人 能 上门 。

晓静 :并 不是 有 限制 的 。

就 时间 的话 ，如果 是 打电话 ，那么 周一 到 周五 ，他们 只 可以 在 早上 九点 到 晚上 八点 之间 打电话 。

2如果 是 星期六 的话 ，是 九点 到 五点 之间 才能 打电话 ，超过 这个 范围 呢 ，他 是 不 允许 的 ，它 属于 违法 的 。

那么 如果 是 上门 拜访 的话 ，那么 周一 到 周五 是 九点 到 晚上 六点 ，那么 周六 还是 九点 到 五点 。

主播 :嗯 ，那 我 还有 一个 问题 ，那 我们 平时 就 作为 一个 消费者 的话 ，如何 来 判断 这种 上门 推销 产品 的 真伪 或 质量 呢 ？

因为 像 有些 人 他们 只是 登门 来 拜访 ， 那 他们 可能 走 了 以后 这个 人 就 再也 找 不到 了 ， 那么 就是 那么 就是 怎么 来 确定 他 所 推销 的 这个 产品 的 质量 的 真伪 呢 ？

晓静 :其实 这 根 任何 的 在 商店 买 东西 一样 ，只不过 去 商店 可能 主观 主动性 比较 强 一些 。

晓静 :那么 当 有人 来 上门 推销 的话 ，就 说 可能 有 一些 压力 或者 是 有时候 她们 就 会 说 有限期 的 那个 优惠 。

晓静 :过 了 这个 时间 就 没有 了 ，有时候 迫于 这种 压力 你 就 立刻 就 做出 了 购买 的 行为 。

主播 :对 。

晓静 :购买 决定 。

所以 呢 我 就 说 对 商品 质量 的 真伪 其实 和 你 任何 在 网上 或是 在 商店 里 买 东西 一样 ，如果 你 不能 确认 或者 对于 他 的 功效 不管 是 质量 还是 功效 不能 确认 的 情况下 ，千万 不要 先 付钱 。

晓静 : 可以 慢慢 让 他 留下 资料 你 再 了解 ， 千万 不要 立刻 买下来 ， 然后 以后 就 像 您 说 的 ， 质量 可能 有 问题 ， 然后 哪怕 找到 人 可能 也 会 碰到 一些 纠纷 。

晓静 :所以 就是说 购买 ，做出 购买 决定 前 呢 ，先 仔细 考虑 一下 ，不要 迫于 压力 而 买 。

那 可是 也 会 出现 一种 情况 就是 我们 发现 这个 质量 出 问题 以后 想 去 找 人 ，但 这个 人 已经 不在 了 ，或者 说 他 之前 留下 的 一个 名片 或是 其他 联系方式 上面 信息 是 假的 。 已经 找不着 这个 人 了 ，那 该 怎么 办 呢 ？

晓静 : 如果 就 说 你 对 上面 来 的 他 的 身份 的 不能 确认 的话 ， 我 建议 大家 就是说 不要 千万 不要 付钱 。

晓静 :就 像 您 说 的 因为 我们 确实 也 碰到 一些 诈骗 的 行为 ，像 以前 说 过 的 一些 游荡型 的 这样 的 推销 行为 。

主播 :嗯 。

晓静 :那么 他们 就是 说 啊 ，一般 推销 的大概 那 是 劳动力 来 修 啊 那个 屋顶 啊 ，修 drive way 啊 ，这种 情况 。

他们 就 通常 到 了 一个 地方 骗 了 一批 人 以后 ，就 离开 到 另外 一个 州 去 了 。

主播 :嗯 。

晓静 :像 碰到 这种 人 是 防不胜防 的 ，所以 在 你 没有 确认 对方 真实 身份 之前 ，我 建议 大家 千万 不要 就是 说 先 付 了 钱 。

千万 不要 迫于 压力 而 去 付钱 ，然后 以后 追悔莫及 。

主播 : 嗯 ， 那 打个比方 哈 ， 有 的 人 上来 推销 他 不是 推销产品 或者说 服务 的 ， 而是 说来 进行 一个 慈善 募捐 ， 他 说 他 是 代表 一个 组织 来 慈善 募捐 。

那 我们 怎么 来 分辨 他 说 他 是不是 真正 的 是 组织 的 一个 代表 呢 ？

晓静 : 那 第一 就是说 他 应该 ， 如果 你 要求 看 他们 的 身份证明 的话 ， 他们 应该 说 就是 很 乐意 地 给 你 看 ， 而且 不会 因为 你 要求 看 身份 而且 先是 说 不 高兴 ， 或者说 有 一些 防御 的 行为 ， 那 第二个 就是说 通常 慈善 组织 的话 ， 他们 预先 就 给 他们 一个 标志 ， 就是说 让 他们 使用 的 ， 鉴别 他们 身份 的 。

但是 说 如果 你 还是 一般 的 大型 的 慈善 募捐 活动 可能 在 之前 ，比如说 为 洪灾 啊 的 地方 ，森林 火灾 啊 ，可能 说 报道 上 媒体 都 会 有 一些 介绍 。 但是 如果 你 还是 不能 确认 的话 ， 就 跟 他们 说 ， 因为 大型 的 慈善 组织 他们 都 有 银行账号 ， 有 他们 网站 ， 都 可以 自己 主动 去 捐款 的 ， 不 需要 立即 给 现金 的 ， 这种 情况 下 你 就 说 你 把 details 留下 ， 那么 就 说 我们 会 做出 我们 自己 捐款 这样 的 决定 ， 不 一定 是 你们 组织 ， 也 可以 通过 其他 组织 捐 。 一般 如果 是 真正 的 这些 组织 来 的人 ，一般 都 会 很 友好 的 离开 了 不会 纠缠 你 的 ，如果 真是 纠缠 你 的 ，要么 就是 说 他 可能 身份 让 人 有 一些 怀疑 的 ，或者 呢 他 没有 经过 慈善 组织 的 专门 培训 ，可能 态度 有些 问题 。

主播 : 嗯 ， 那 我 还 遇到 过 这种 情况 啊 ， 就是 有些 像 那种 来自 电力公司 的 一些 推销员 ， 他们 其实 是 说 想 登门拜访 之后 呢 ， 想 希望 户主 能够 改变 电力公司 的 这些 合同 ， 于是 呢 他们 会 要求 由 对方 提供 你 现在 所 使用 的 有关 一些 什么 电力 账单 的 这些 信息 来 给 他 看 。

那 他们 是不是 有 权利 这样 做 ？

晓静 : 通常 呢 如果 是 真的 是 代表 电力公司 的 ， 因为 他们 ， 我 自己 也 碰到 过 ， 之所以 他 要 问 你 这些 信息 的话 ， 他们 给 的 说法 就是说 他们 要 根据 你 的 用量 来 给 你 一个 比较 好 的 计划 ， 什么 情况 下转 是 优惠 的 ， 那么 这种 情况 下 如果 你 担心 个人隐私 情况 的话 ， 你 不用 给 他 看 ， 就 告诉 他 大概 的 我 用电 的 情况 ， 一般 的 这个 如果 他们 是 专业 的 销售 人员 的话 ， 这些 信息 都 应该 知道 ， 不 一定 要 看到 账单 才 做 决定 ， 你 是 口述 就行 。

当然 就是 你 在 对 他 的 推销 的 产品 或者 服务 感兴趣 的 情况下 ，你 才 这么 做 。 通常 电力公司 他们 对 员工 销售 应该 也 是 有 严格 培训 的 ， 不能 就是说 有 骚扰 的 行为 ， 而且 一旦 你 真的 签了 合同 之后 你 觉得 有些 后悔 的话 ， 他 也 是 有 10 天 的 冷静 期 的 ， 所有 上门 推销 ， 电话 推销 如果 第一次 你 就 成交 了 ， 都 有 10 天 的 冷静 期 的 。

晓静 : 嗯 ， 大多数 情况 下 是 需要 通知 strata 因为 如果 仅仅 说 是 换 一个 里面 的 橱柜 一般 是 不 需要 ， 但是 如果 你 是 翻新 浴室 ， 要求 动 他 的 管道 特别 是 那个 下水道 啊 或者 是 跟 浴缸 和 厕所 跟侧 盆 连接 的 管道 的话 ， 他们 属于 公共 部位 ， 因为 连接 的 部分 都 属于 公共 部分 ， 一定 要 到 (owner's corporation) 业主 委员会 或者 是 你们 的 管理 中介 那边 去 报备 。 得到 他们 同意 以后 ，然后 告诉 他们 大概 什么 时候 开工 ，是 需要 告诉 他们 的 。

听众 :那 我 要 不要 需要 书面 简单 通知 ，大概 要 多长时间 答复 啊 。

晓静 : 就是说 法律 没有 明确规定 一定 要 要 书面 或者 一定 有 限期 ， 但是 你 一定 要 得到 他们 同意 以后 你 才能 开工 。

除非 你 进行 施工 的 东西 呢 是 不 涉及 任何 公共 部位 的 ，那 就 不 需要 得到 他们 同意 。

听众 :因为 我 主要 把 里面 那 瓷砖 拆掉 ，有 声音 ，我 就是 通知 strata ，然后 他 就 叫 我 什么时候 就是说 一个 书面 一个 考察 研究 是 吧 。

就是说 一般 建议 书面 ，这样 的话 ，你 到时候 说 的 清楚 ，然后 。

我们 的 准 造假 只要 花 两三千 块钱 。

晓静 :嗯 ，对 ，那 一般 就是 跟 内部 管道 有 关系 的 ，那 就是 通过 业主 委员会 批 就 行 。

晓静 就是 如果 要是 上门 推销员 他们 来 卖 的 是 自己 手工 制作 的 一些 的 商品 的话 ， 那 无论是 从 质量 上 各 方面 的话 他 是 如何 来 保证 呢 ？

晓静 :就要 说 他 是 一个 生意 行为 ，他 就 说 不是 说 偶尔 一次 到 邻居 家里 说 ，你 需要 不 需要 我 家里 一件 东西 我要 扔掉 了 ，这种 属于 私人 销售 ，不 属于 任何 的 商业 行为 。

但是 如果 他 是 用 这个 来 牟利 ， 长期 的 商业行为 的话 ， 这些 都 是 要 受到 澳大利亚 消费者 法律 保护 ， 就是 它 的 质量 一定 要 过关 ， 如果 有 问题 的话 ， 根据 澳大利亚 消费者 法律 对 他 进行 要求 退款 或 换货 的 。

听众 : 嗯 ， 另外 我要 请教 有 关于 推销 的 ， 因为 他 可能 公司 给 他 压力 了 ， 要 他 说 有 推销 到 你 这里 推销 ， 他 就是 让 你 登记 地址 以外 ， 有时候 还要 我们 姓名 啊 ， 有时候 还 让 我们 签个 字 啊 。

这个 应该 不要紧 吧 。

晓静 :就是说 如果 你 认可 他 的 销售 行为 ，而且 对 他 东西 感兴趣 要 购买 的话 ，法律 上 是 要求 他 必须 准备 一个 书面 合同 。

不管 是 当场 给 你 还是 以后 寄 给 你 ，它 是 需要 准备 这样 一个 合同 的 ，那么 这个 销售 行为 才 有效 的 。 那么 如果 签合同 的话 ，通常 他 是 要求 有 姓名 的 。 但是 他们 得 遵照 澳大利亚 的 隐私 法 。 就是 您 提供 的 姓名 ， 他 只 适用 于 这次 销售 或者 是 相关 的 他们 的 公司 业务 ， 而 不会 作为 其他 的 销售 你 个人隐私 信息 给 外界 而 牟利 ， 所以 如果 他们 触犯 了 您 的 隐私 的话 ， 是 有 专门 的 地方 可以 投诉 的 ， 但是 就 像 刚才 说 的 ， 如果 你 对 他们 的 销售 行为 ， 或者 他们 要求 的 任何 信息 有 一些 怀疑 或者 是 有 不 放心 的话 ， 你 可以 拒绝 他们 的 销售 。

听众 :非常 喜欢 这个 节目 ，觉得 这个 话题 很 有用 。

家里 有 小孩 ，有时候 我 不 希望 有 生人 到 家里 来 敲门 ，因为 小孩 有时候 不 知道 什么 时候 该 开门 什么 时候 不该 开门 。 这个 我 觉得 是 这种 文化 可能 在 过去 的 澳大利亚 比较 适合 ，但是 现在 这种 环境 太 复杂 了 ，很 难 再 延续 这种 销售 和 推销 的 方式 。 第二 我 觉得 上次 周末 的 时候 家里 其实 有人 ，但是 大家 各干各的 ，可能 外面 人 进来 看不见 家里 有没有 人 。 我 女儿 说 他 看到 那个 人 就 直接 来 拉门 的 拉手 没有 敲门 ， 先拉 的 门拉手 ， 但是 后来 我们 发现 有人 的 时候 我 老公 去 问 他 说 是 干什么 ， 他 说 是 卖房子 的 ， 但是 他 带 的 是 草帽 穿 的 是 衬衣 没有 领带 。 然后 他 拿 了 张 名片 上 ， 但是 名片 上 没有 照片 的 ， 我们 不能 证明 那个 名片 就是 他 的 ， 所以 我 觉得 这 是 很 奇怪 ， 因为 小孩 挺 大 的 ， 他 不会 说 瞎话 的 ， 他 是 说 那个 人 是 先 拉 的 门 。

晓静 :像 这种 情况 我 觉得 大家 比较 注意 ，就是 尽管 家里 有人 ，如果 就是说 特别 家里 有 小孩子 ，尽量 把 铁门 啊 什么 们 ，关 起来 锁 起来 ，不要 出现 这种 情况 ，因为 很多 人 他 并不 一定 真的 就是 合法 销售 人员 。

他 可能 是 有 一些 ，真的 现在 社会 上 你 说 这么 多人 ，也 不能 防止 这种 犯罪 行为 。 经常 听到 一些 各种 小孩子 失踪 啊 这样 事情 ，所以 大家 还是 警惕 意识 ，你 觉得 不对 的话 ，你 可以 拒绝 这些 人 上门 。 但是 就是说 说 如果 你 自己 要 做好 一些 防范 的 措施 ，比如说 铁门 ，最好 让 小孩 够不到 的 锁 啊 ，特别 是 有 一些 小小孩 在 家 的 家庭 。

听众 :还有 我 觉得 有没有 办法 就是 在 前面 我们 写 什么 标志 能够 禁止 他们 进来 ，因为 这是 我们 自己的 选择 。
