Nancy López: En un mundo ideal ¿cómo terminaría esta historia?

Felipe Montes: Para mi no existe el mundo ideal.

Nancy López: ¿O sea para tus hijos, para ti, para tu familia?

Felipe Montes: Este…como lo dije antes: planes para mi no hay planes. Prefiero vivir dia a dia.

Daniel Alarcón: Este es Felipe Montes. Y se le escucha cansado. Frustrado. No es para menos. Tenía toda una vida en Estados Unidos, y lo perdió todo. No tuvo otra opción que regresar a México. Ahora lleva cinco meses ahí con sus tres hijos, y ha sido difícil encontrar trabajo. Dice que esta desesperado…

Felipe Montes: Sentirte como que eres… que nadie… no puedes ser servible para algo, como se dice, useless, que solamente estás sentado en la casa sin hacer nada. A veces que mi mama sale, tiene un pequeño trabajo, me quedo yo en la casa, cuido los niños, limpio la casa, hago de comer o lo que haya que hacer, no hay otra cosa que más hacer.

Daniel Alarcón: Bienvenidos a Radio Ambulante. Soy Daniel Alarcón. Hoy, Un Mundo Ideal: La historia de Felipe Montes.

Hay muchos como él. Pero como veremos, la situación de Felipe es bastante especial.

Nuestra productora, Nancy López, nos cuenta más.

Nancy López: Para entender bien cómo fue que Felipe llegó a este punto, debemos devolvernos al año 2010.

Nancy López: Felipe vivía indocumentado en Sparta, un pueblo en Carolina del Norte. Él había vivido ahí durante 10 años; empezó cortando pinos para Navidad y después se dedicó a la jardinería. Se arriesgaba a manejar sin licencia. No había otra manera de llegar al trabajo. Y fue acumulando multas de tráfico hasta que lo pusieron bajo libertad condicional.

Felipe Montes: El oficial de probación me iba a visitar una vez al mes a mi casa y yo venía a visitarlo una vez al mes a su oficina.

Nancy López: Felipe llevaba 9 meses bajo libertad condicional. Hasta que un día en octubre, un lunes por la tarde, el oficial que supervisaba a Felipe llegó a su casa. Le dijo que se iba de vacaciones y que necesitaba verlo en su oficina antes de irse.

Felipe Montes: Quería verme un miércoles en la mañana, a las 8 de la mañana. Yo pense que todo estaba bien. Cuando yo entré estaba otro oficial de probación y dos oficiales de ICE ya esperándome.

Nancy López: ICE, es decir, la agencia que implementa la ley migratoria de Estados Unidos.

Felipe Montes: En cuanto llegue me dijeron que ya estaba en deportación, me tomaron los brazos, me esposaron de pies y manos y cintura. Pues más que nada me sentí mal, frustrado porque acababa de dejar a mis hijos en el daycare. mi esposa estaba embarazada y estaba esperandome para llevarla a una visita del doctor… y ya no pude llegar.

Nancy López: Para entonces Felipe y su esposa Marie tenían dos niños pequeños – Isaías de tres años y Adrián de uno. Marie estaba embarazada con el tercero – este se llamaría Ángel. Todo pasó muy rápido. Los oficiales de ICE transportaron a Felipe a la ciudad de Charlotte, a dos horas de su casa y de su familia.

Felipe Montes: Cuando me comuniqué con mi cuñada, le expliqué que le fuera a decir a mi esposa que estaba en detención de ICE. De ahí me mandaron a Sur Carolina por una semana, de Sur Carolina me transfirieron a Atlanta, Georgia y de ahí estuve siete semanas en detención en Georgia hasta que me deportaron a México.

Nancy López: El país que había dejado hace 10 años.

Felipe Montes: Mi preocupación mayor era mis hijos Nancy López: ¿Por qué? Felipe Montes: Porque al faltar yo, yo sabía que Servicios Sociales iba a estar involucrado y se los iban a quitar a mi esposa.

Nancy López: Y es exactamente lo que pasó.

Nancy López: Hay que explicar algo aquí, un detalle importante. Felipe mantenía a la familia — y no sólo económicamente. También cuidaba a sus hijos y a su esposa, Marie, quien ha tenido problemas de salud mental y drogadicción. Y debido a estos problemas, la familia ya estaba en la mira del departamento de Servicios Sociales. Marie había perdido la custodia de su primera hija, años atrás, antes de siquiera conocer a Felipe.

Felipe sabe lo que es crecer sin sus propios padres. Él se fue de su casa a los 12 años porque no soportaba el maltrato de su padrastro. No quería que sus propios hijos sufrieran el mismo abandono.

Pero ahora, desde México, no pudo hacer nada cuando el estado de Carolina del Norte le quitó los hijos a Marie. A Isaías y a Adrián se los dieron a una familia temporal. Y Ángel, en cuanto nació, fue entregado a otra familia.

Felipe Montes: Los primeros meses fue muy difícil, cuando fui deportado. Personas ya no me conocían, yo cambie mucho de apariencia, iba a pedir trabajo y me tenían miedo, pensaban que era alguno de los malos.

Nancy López: Cuando Felipe dice “los malos” se refiere a las bandas de narcos matándose en su estado natal, Tamaulipas. Con la ayuda de un tío, logró conseguir trabajo en Monte Morelos, Nuevo Leon, recogiendo nueces en una finca. No hacía más que trabajar y pensar en Marie y en sus hijos. Compró un celular y empezó a comunicarse con Marie. Hablaban de los niños y cómo hacer para recuperarlos.

Nancy López: Mientras tanto, un juez en Sparta iba a determinar qué hacer con los niños. Para Felipe y Marie la solución lógica, y la que presentaron a los oficiales en Sparta, era que los niños fueran a México para estar con su padre. Pero esta propuesta fue rechazada. Los oficiales recomendaron al juez que los tres niños fueran dados en adopción.

Nancy López: Es importante resaltar que hay muchas personas como Felipe. Miremos las cifras: Una investigación reciente reveló que alrededor de 180 mil padres de niños ciudadanos han sido deportados en los últimos dos años. El resultado: más de cinco mil niños se encuentran bajo la custodia del gobierno estadounidense, en hogares infantiles o con familias temporales. Es decir, al ser deportados, muchos padres pierden la custodia de sus hijos – sin jamás haber tenido la posibilidad de regresar al país legalmente y reclamar sus derechos.

Y es por eso que el caso de Felipe es extraordinario. Él sí tuvo la oportunidad.

Noticiero 1: “Felipe Montes, un inmigrante indocumentado cuyo caso de lucha por la custodia de sus tres hijos ha tenido eco a nivel nacional…”

Noticiero 2: “Con el argumento de que ser padre es un derecho fundamental, Felipe Bautista Montes se presentó…”

Noticiero 3: “La increíble historia de Felipe Montes. Él entró ilegalmente a los Estados Unidos en el año 2003. Se casó, tuvo tres hijos…”

Nancy López: La historia de cómo Felipe perdió a sus hijos salió en algunos medios estadounidenses, y de la noche a la mañana, Felipe se volvió un símbolo de la crisis que sufren las familias al ser separadas. Una organización de activistas Latinos lanzó una campaña para llamar la atención sobre el caso. El consulado mexicano en Carolina del Norte se unió a estos esfuerzos. Contactaron a Felipe en México y le consiguieron una abogada de inmigración. Ella le dijo que solo le quedaba una opción: Para volver al país y pelear por la custodia de sus hijos necesitaba un permiso humanitario de Estados Unidos.

Nancy López: Felipe aplicó al permiso. Pero pasó un mes, pasó otro y no recibía noticias de la abogada. Para entonces ya llevaba un año y medio sin ver a sus hijos, aunque hablaba de vez en cuando con ellos por teléfono. Se empezó a desesperar.

Nancy López: Esta fue la primera victoria para Felipe. Regresó a Sparta el primero de agosto del 2012. En cuanto su avión aterrizó en Charlotte, Felipe tuvo que reportarse a las autoridades migratorias del aeropuerto. En el tobillo derecho le pusieron un brazalete electrónico. Le avisaron que no podía moverse más allá de 60 millas fuera de Sparta. Tampoco podía manejar ni trabajar. Esas eran las condiciones de su visa.

De todas formas, llegó lleno de esperanza, y ansioso por ver a sus hijos. Cuando amaneció, al día siguiente, fue directamente a la guardería infantil donde estaban Isaías y Adrián. Llevaba en la mano juguetes y dulces que había traído de México. Pero al entrar por las puertas de la guardería se enfrentó con una sorpresa. La directora le dijo que tendría que pedirle permiso al Departamento de Servicios Sociales antes de poder ver a sus hijos.

Nancy López: Después de un par de días, finalmente consiguió la cita. Cuando llegó a la oficina de servicios sociale, sus hijos estaban jugando en un cuartito lleno de juguetes. Isaías ya tenía 5 años, Adrián 3 y Angel, el hijo al que Felipe iba a conocer por primera vez, tenía 2. Ahí estaba un trabajador social para observar a Felipe y a los niños. Pero lo que este padre no se esperaba era sentirse tan ajeno a sus propios hijos. Los quiso abrazar pero los dos pequeños – Adrián y Ángel – no lo conocían y se pusieron nerviosos. Isaías, el mayor, lo reconocia pero no entendía qué estaba pasando.

Felipe Montes: Lo primero que me dijo mi niño, dice, “¿Me vienes a adoptar?”. Casi se me salen las lagrimas y le dije “No, yo no vengo adoptarte, yo soy tu padre y vengo por ti porque te quiero y quiero que estes conmigo. Así que yo no te vengo a adoptar, yo vengo por ti”.

Nancy López: Felipe pasaría los siguientes meses explicándoles a sus hijos que él nunca los quiso dejar. Por otro lado también tenía que comprobar que era un buen papá.

Felipe Montes: Primero fueron las visitas supervisadas. Empece con una hora…después subió a dos horas, después subió a cuatro horas, de cuatro horas a seis horas. Después empecé con una vista supervisada de todo un día, después fueron las que le llaman aquí overnights: pasar un día completo y una noche con ellos.

Nancy López: En la corte estaba una representante de los niños y los papás que se habían encargado de ellos. Todos estaban abogando para que los niños se quedaran a vivir en Estados Unidos y fueran adoptados por estas familias.

Felipe Montes: Querían verme como mal persona, como mal padre ante el juez.

Nancy López: ¿Qué dijeron, por ejemplo?

Felipe Montes: Que los tenía muy mal atendidos y que me interesaba más por mi esposa que por los niños. ¿Qué se siente? se siente un coraje como…no un odio, pero algo parecido.

Nancy López: Pero quizá lo que más le dolió a Felipe fueron las cosas horribles que les decían a sus hijos. Un día llegó Adrián con una pregunta.

Felipe Montes: El medianito me decía: “Papá yo no me quiero ir a México porque tu andas matando gente allá en México…” Eso fue lo que le decían los foster parents.

Nancy López: Los padres temporales.

Felipe Montes: Me daba un coraje muy grande, me daba un poco de sentimiento que si en verdad estas personas querían los niños para qué inventarles historias, para qué hablar mal de los padres biológicos. Le dije que no era cierto, que es una… que era falso, que yo no mato gente, que yo soy su padre, que vine por ellos porque los quiero y quiero estar con ellos y que ellos estén conmigo. De hecho nunca he sido violento, nunca he sido agresivo.

Nancy López: Hay un aspecto del caso que no se ha discutido de manera abierta. Cuando Felipe estaba en México, sin posibilidad de defenderse, la abogada representando a los niños había dicho que México es un país muy peligroso debido a toda la violencia. Que Felipe no podría mantener a sus hijos de manera adecuada allá. Que a los niños les convenía mejor quedarse en Sparta y ser adoptados por las familias de clase media que los habían cuidado durante estos últimos dos años.

No se puede negar que México se ha vuelto un país violento. Y la guerra del narcotráfico ha cobrado miles de víctimas. Pero hay que entender lo que implica este argumento. Implica que ser pobre, o vivir en una zona de conflicto, justifica la anulación de los derechos de un padre.

Carlos Flores es el cónsul mexicano de Carolina del Norte, y estaba ayudando a Felipe. Él lo explica así:

Carlos Flores: Yo no aceptaría que a mi me dijeran, oiga sus hijos, y tengo dos hijos, estarían mejor viviendo en Suecia que viviendo con usted ahora en Carolina del Norte y quizá mañana en Oaxaca, México. Yo no tomo a bien esos consejos porque para mi lo mas importante de todo es que ellos son mis hijos y posiblemente para ellos también lo más importante es que yo soy su padre.

Nancy López: Ahora que Felipe estaba de vuelta en Sparta, en carne y hueso en la corte, era mucho más difícil presentarlo como un padre ausente o negligente. Esto fue lo que Felipe le dijo al juez:

Felipe Montes: Yo no quiero que mis hijos vivan con otras familias que no son de su sangre, que ni siquiera los conocen. Tal vez les demuestren cariño pero nunca va a ser lo mismo que un verdadero padre o una verdadera madre. Tal vez aquí es América: más oportunidades, más economía. Pero en cuestión de sentimiento, es cuestión de sangre, la sangre llama a sangre.

Nancy López: Durante el proceso judicial se hizo obvio que el Departamento de Servicios Sociales no estaba preparado para manejar un caso como este. Es decir, no tenían protocolo para lidiar con los derechos de un padre que está fuera del país. No importa si ese padre está en México, Francia, o Australia.

Y no solo existía este vacío legal… De repente lo que se estaba juzgando no era si Felipe era un buen padre, sino si México era un país adecuado para criar niños. El departamento de servicios sociales pidió un estudio socio económico de Tamaulipas. Carlos Flores, el cónsul mexicano, se los consiguió, sorprendiendo a todos. El dice que el documento….

Nancy López: Y otra cosa que nadie parecía haber considerado: que los niños no son únicamente americanos, también son mexicanos. El padre les transmite la nacionalidad.

Carlos Fuentes: Quizá ese fue el choque informativo o cultural más duro, porque ellos decían, “No, esos niños no son mexicanos, son de aquí, aquí nacieron, son americanos cien por ciento”. Y yo creo que tomó algunos días y unas semanas para que la gente de social services en Aleghany county dijeran “vamos a tener que aceptar que hay doble nacionalidad”.

Nancy López: Lo que supuestamente iba a durar tres meses se fue alargando. Afortunadamente seguían extendiéndose a Felipe su permiso para estar en el país. Pero no podía trabajar y dependía del consulado mexicano. Le pagaban un hotel donde vivía y le crearon una cuenta en un restaurante mexicano donde comía todos los días.

Y mientras tanto Felipe seguía fortaleciendo la relación con sus hijos. En diciembre del 2012, después de cuatro meses de visitas supervisadas, el juez ordenó que lo iban a poner en prueba: durante 60 días, los niños podrían vivir con él, tiempo completo. Otra gran victoria para Felipe.

Nancy López: En febrero del 2012 lo visité en Sparta. Isaias, Adrian y Angel llevaban casi tres meses viviendo con él. Cuando llegué, Felipe estaba limpiando la sala mientras los niños jugaban. Se veía tenso. Tenía dolor de cabeza.

Al día siguiente el juez iba a dar su decisión final sobre la custodia de los niños. El camino hasta este momento había sido muy largo y Felipe dijo que, tal vez, fueron los meses más duros de su vida.

Nancy López: Tanto que, cuando uno de sus hijos llegó de la escuela con un rasguño, Felipe le dejó saber al trabajador social inmediatamente. No quería que lo culparan de maltrato.

Nancy López: En la sala, los niños se veían a gusto con su padre. Si uno no estaba colgado de su brazo el otro le jalaba las pantalones para llamarle la atención. Felipe me dijo que no es nada fácil cuidar a tres niños pequeños solo, pero que son sus hijos.

Nancy López: La mañana de febrero 19 Felipe llegó temprano a la corte. Alrededor de las 12 del día, el juez dio el veredicto final: A Felipe Montes le daban la custodia de Isaías, Adrián y Ángel.

La abogada de Felipe, Donna Shumate dice que el juez determinó que Felipe era un padre con capacidad de cuidar a sus hijos. Y el hecho de que sea indocumentado, de que haya sido deportado, y de que haya tenido infracciones de tránsito, no tienen nada que ver con su habilidad como padre.

Si dejaramos la historia de Felipe aquí se podría decir que tuvo un final feliz. Pero como ya hemos visto, la vida real suele ser mucho más complicada.

Felipe esperaba poder extender su visa para quedarse en Sparta, porque durante todo este tiempo, él seguía con Marie y ella quedó embarazada de nuevo con su cuarto hijo. Desafortunadamente ella seguía con problemas de salud y con la ley. Marie no iba a poder viajar a Mexico y Felipe tampoco la quería dejar sola.

Pero no le extendieron el permiso. Y no le quedó otra opción a Felipe que abordar un avión rumbo a México con Isaías, Adrián y Ángel. Nuestra productora Nancy López los visitó ahí, en Michoacán, donde habían decidido rehacer sus vidas. Aqui Nancy.

Nancy López: Para Felipe y los niños el primer mes en México fue muy inestable. Después de dos semanas en Tamaulipas, Felipe decidió mejor irse a Sahuayo, Michoacán, donde vive su mamá. La inseguridad en Tamaulipas había empeorado y su mamá le dijo que lo ayudaría con los niños. Ya en Sahuayo consiguió trabajo moviendo chatarra – fierros, aluminio, cobre. Pero el trabajo solo duraba cinco días. Y a fin de cuentas solo se ganó mil pesos, menos de 20 dólares diarios. Y me dijo que desde ese entonces no ha conseguido más trabajo.

Marie: “Aviéntasela a Adrián hijo, aviéntasela, aviéntasela…”

Nancy López: Felipe también está preocupado por sus hijos. Se están acoplando a su nueva vida. Se han encariñado con su abuela, juegan con sus tíos y con los vecinitos, pero aun así expresan un temor muy grande de que su papa los va a abandonar. El primer día que Felipe fue a trabajar, los niños se quedaron con la abuela. Lloraron todo el dia. Cuando Felipe llegó del trabajo…

Felipe Montes: Llegué caminando, todo sucio, lleno de aceite, oxido de los fierros…Me preguntan: “¿Dónde estabas?”

Nancy López: Isaias y Adrian, muy serios, le empezaron a reclamar.

Felipe Montes: Me dicen, “¿por qué nos dejaste?”. Le digo, “No los deje, me fui a trabajar”. Y dice, “¿y para qué vas a trabajar?”. Le digo, “Bueno, te gusta tomar leche, quieres dulces, quieres nieve”, le digo, “necesito dinero para todo eso”.

Nancy López: Si no encuentra trabajo pronto Felipe tiene planes de dejar a los niños con su mamá mientras él va a buscar trabajo en otro estado. Y llegado el momento, no sabe muy bien cómo les va a explicar que tiene que irse.

Felipe Montes: Porque van a pensar que los voy a abandonar y pues más bien no pienso que es abandono pero se siente así. Pero no lo hago por mi, lo hago por ellos.

Nancy López: En Sparta, el departamento de servicios sociales había dicho que México es demasiado peligroso, que aquí Felipe no podría hacerse cargo de sus hijos. Y de cierta forma, Felipe se ha enfrentado con esa misma realidad. Se tuvo que ir de Tamaulipas por la inseguridad. Y ahora, después de una lucha tan extensa para ganar la custodia de sus hijos, quizá tendrá que separarse de ellos para buscar trabajo. Pero Felipe sigue convencido que él puede sacar a sus hijos adelante.

Felipe Montes: Porque pobreza hay en todo el mundo, problemas hay en todo el mundo. Cuando estuve en Estados Unidos si duré un año sin trabajar. En Estados Unidos si no tienes licencia es como estar aquí en México sentado sin tener un trabajo.

Nancy López: Felipe no puede negar que si fuera por el estaría con sus hijos en Estados Unidos y ese es el futuro que se imagina. Para él esta historia no tendrá un final feliz hasta que logre volver. Por eso su gran esperanza, como la de cientos de miles de inmigrantes en la misma situación, es que los Estados Unidos pase una reforma migratoria, para así poder continuar la vida que tuvo que dejar.
